RISK OF LOSS
All items purchased from EAV – ETTRICK AUDIO VISUAL are made pursuant to a shipment contract. This basically means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
PRODUCT DESCRIPTIONS
EAV – ETTRICK AUDIO VISUAL and its associates attempt to be as accurate as possible. However, EAV – ETTRICK AUDIO VISUAL does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by EAV – ETTRICK AUDIO VISUAL itself is not as described, your sole remedy is to return it in unused condition.
UNSUITABLE GOODS OR CHANGE OF MIND
Not withstanding our warranty policy, if you are dissatisfied with our goods or service you may return the goods within fourteen days of our despatch date. It is essential to obtain an authorisation number prior to returning any goods to us. Contact us here. We will refund your purchase in full, less freight costs on receipt of the goods. All returned goods must be in “as sold” condition including all packaging, instructions, invoices and unbroken seals where applicable etc. Some of our products are damaged by incorrect handling and attract no warranty if not installed by an authorised repairer of the brand. Please choose carefully. We do not accept unauthorised returns.
FAULTY GOODS
Where such goods have been supplied and confirmation of failure is provided by an authorised repairer of the brand, we undertake to repair or replace on an “express service” basis. It is essential to obtain an authorisation number prior to returning any goods to us. Contact us here. We do not accept unauthorised returns. Return freight cost will apply where upon inspection there is no fault found with the supplied goods.
DISPUTES
Any dispute relating in any way to your visit to EAV – ETTRICK AUDIO VISUAL or to products you purchase through EAV – ETTRICK AUDIO VISUAL shall be submitted to confidential arbitration in WESTERN AUSTRALIA, AUSTRALIA, except that, to the extent you have in any manner violated or threatened to violate EAV – ETTRICK AUDIO VISUALs intellectual property rights, EAV – ETTRICK AUDIO VISUAL may seek injunctive or other appropriate relief in any state or federal court in the state of WESTERN AUSTRALIA, AUSTRALIA, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the Institute of Arbitrators & Mediators Australia. The arbitrators award shall be binding and may be entered as a judgement in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
